QUESTION: Got into a car accident and had a passenger in my car that was not wearing his seat belt so he got hurt the most by hitting his head on the dashboard. I also hit another car which there was one person in the car. She had the least amount of injury and her car was already taken cared of by my insurance company. I had AIG as my insurance at the time and I was under my parents on their plan which was no fault. I made an illegal turn into a road but was not speeding. I did not see the car coming in the oppositie direction and we collided. I was drinking that night and I just found out yesterday my alcohol level was a shocking .18 which is 3x the legal limit. I am 22 years old and this is my first offence I am scared to death I am going to get sued and get a DUI which will prevent me from living fully. I got pregnant 1 week after the accident which was a blessing but i'm pregnant with twins and am a worried wreck. The two other people both have attorneys and I cannot afford one. I don't have a job either.. if I get sued I will have to file bankrupsy.. I am scared about the DUI I heard I get a greater penalty for having an alcohol count of THAT high. ANSWER: Charges may most likely be filed against you for DUI. If the car is registered under your name, and based on what you've described, you'll be "at fault". I assume the police showed up, and if they did, then the insurance company will get a copy of the police report. Once the insurance company determines that this is your fault, AIG will cover all of the expenses for damages for each car; and any hospital expenses, if any. Lets hope that the damages will not exceed your maximum coverage. Your insurance appraiser will make that determination. If you're covered under your parents insurance policy, this entire incident will be taken care of under the policy. However, during the meantime, it would be in their best interest to eventually drop you off of their policy. Their policy with go SKY HIGH or possibly get canceled due to this incident. Now, you're on your own in the event you continue to drive and need a new insurance policy. You'll pay dearly if and when you happen to find any new insurance company that'll cover you (you're now considered "high risk"). Your DUI issue, you'll have to deal with the criminal DUI issues if your receive a summons to appear in court. If you can't afford an attorney, go see a public defender at the courthouse BEFORE your scheduled court date (again, this is only if you receive a summons to appear in court for the DUI). They may be able either represent you or explain the process you'll need to go through when you're in court. First offense for DUI will more than likely be no jail time, however your driver's license may be either suspended for restricted & limited to travel to/from school and/or work. ANSWER: GET A LAWYER! You can be held directly liable as well as your employer. You can be held personally liable because you were the one who broadsided the car. As for your employer they can be held liable because you were directly performing a job duty (driving the bus) when the accident occured. QUESTION: i don't know where to begin. I have a very cold hearted, father and mainly its my mom that suffering. Ever since Obama assumed the office of President, critics have hammered him on a number of Constitutional issues. Critics have complained that much, if not all of Obama's major initiatives run headlong into Constitutional roadblocks on the power of the federal government. Obama certainly did not help himself in the eyes of the Court when he used the venue of the State of the Union address early in the year to publicly flog the Court over its ruling that the First Amendment grants the right to various organizations to run political ads during the time of an election. The tongue-lashing clearly did not sit well with the Court, as demonstrated by Justice Sam Alito, who publicly shook his head and stated under his breath, 'That's not true,' when Obama told a flat-out lie concerning the Court's ruling. As it has turned out, this was a watershed moment in the relationship between the executive and the judicial branches of the federal government. Obama publicly declared war on the court, even as he blatantly continued to propose legislation that flies in the face of every known Constitutional principle upon which this nation has stood for over 200 years. Obama has even identified Chief Justice John Roberts as his number one enemy, that is, apart from Fox News and Rush Limbaugh, Beck, Hannity, and so on. And it is no accident that the one swing-vote on the court, Justice Anthony Kennedy, stated recently that he has no intention of retiring until 'Obama is gone.' Apparently, the Court has had enough. The Roberts Court has signaled, in a very subtle manner, of course, that it intends to address the issues about which Obama critics have been screaming to high heaven. A ruling against Obama on any one of these important issues could potentially cripple the Administration. Such a thing would be long overdue. First, there is Obama Care, which violates the Constitutional principle barring the federal government from forcing citizens to purchase something. And no, this is not the same thing as states requiring drivers to purchase car insurance, as some of the intellectually-impaired claim. The Constitution limits FEDERAL government, not state governments, from such things, and further, not everyone has to drive, and thus, a citizen could opt not to purchase car insurance by simply deciding not to drive a vehicle. In the Obama Care world, however, no citizen can 'opt out.' Second, sources state that the Roberts court has quietly accepted information concerning discrepancies in Obama's history that raise serious questions about his eligibility for the office of President. The charge goes far beyond the birth certificate issue. This information involves possible fraudulent use of a Social Security number in Connecticut , while Obama was a high school student in Hawaii. And that is only the tip of the iceberg. Third, several cases involving possible criminal activity, conflicts of interest, and pay-for-play cronyism could potentially land many Administration officials, if not Obama himself, in hot water with the Court. Frankly, in the years this writer has observed politics, nothing comes close to comparing with the rampant corruption of this Administration, not even during the Nixon years. In addition, the Court will eventually be forced to rule on the dreadful decision of the Obama DOJ suing the state of Arizona. That, too, could send the Obama doctrine of open borders to an early grave, given that the Administration refuses to enforce federal law on illegal aliens. And finally, the biggie that could potentially send the entire house of cards tumbling in a free-fall is the latest revelation concerning the Obama-Holder Department of Justice and its refusal to pursue the New Black Panther Party. The group was caught on tape committing felonies by attempting to intimidate Caucasian voters into staying away from the polls. A whistle-blower who resigned from the DOJ is now charging Holder with the deliberate refusal to pursue cases against Blacks, particularly those who are involved in radical hate-groups, such as the New Black Panthers, who have been caught on tape calling for the murder of white people and their babies. This one is a biggie that could send the entire Administration crumbling--that is, if the Justices have the guts to draw a line in the sand at the Constitution and the Bill of Rights. In passing this on it is no wonder Americans of every race and political persuasion are disgusted.

QUESTION: So this crazy lady said I hit her car one day while we were in traffic. This was complete bs, so I ignored her and kept it moving. Apparently she then went and filed a police report saying that I hit her and ran, left the scene and caused damage to her car. More bs. I have a very nice luxury car, she had a pos truck, so if I did hit her, my little car would have been banged up, not to mention I would have felt it. So she gets a copy of the police report with my address and the very next night my car is damaged over night. I am not stupid, I can put 2 and 2 together. I file a complaint and keep it moving. So I get an attorney to the tune of $1000 and go to court for the first appearance and she does not show. The court says they didn't mail her a letter to show so I get a new date. Last week I go to court again and she no shows, this time the court did send her a letter. My attorney had the judge dismiss the case and now I guess it is over. I know she has 30 days to reopen the case if she was deathly ill or in the hospital on the court date but we all know that was not the case. So now I am out $1000 for an attorney, 1 missed day of work, 2 days having to leave early for court. Not to mention this 'mysterious' dent on the hood of my car. Out all this when I didn't even do anything wrong and she gets to walk off free as a bird even though she lied to the cops, filed false police reports and no showed in court? How is this fair? I just want my money back for the attorney fee. I want to use that money for a vacation to Hawaii, not to entertain some crazy, jealous broads need for attention. Anyone care to help, do I go to Small Claims? How do I end up not getting screwed for something I didn't do?
ANSWER: You may be able to sue her but you must prove malice on her part which is very hard to do and would end up costing you more in the long run than what you could possibly win in a small claims case.
QUESTION: This is a "no-fault" state. I found out that my insurance crash limitations only covered $10,000 in coverage (lame, I know!). But my car alone had $2,500 in damage. But the two other cars had very little damage, HOWEVER, one of the cars was a 2006 Cadillac (EEK!). In an accident, under no fault laws, your auto insurance company will pay for your damages (up to your policy limits), regardless of who was at fault for the accident.
